Terms & Conditions / Terms of Sale
Elate Digital Art Gallery is a registered DBA of Elate Business Concepts Group, LLC. “Elate,” “we,” “us,” and “our” refer to Elate Business Concepts Group, LLC doing business as Elate Digital Art Gallery.
Each order is governed by the version of these Terms and the applicable policies presented to the customer at checkout when the order is placed. Elate retains the accepted policy version with the order record. Later material policy changes do not apply retroactively to an existing order unless required by law.
Products and Services
Elate offers artwork, made-to-order prints, professionally framed and finished presentations, custom-art services, and selected Marketplace products. Available sizes, substrates, frames, mats, glazing, mounting, backing, hanging hardware, and related production options may vary according to production-provider capabilities and destination limitations. Product pages and checkout identify the selected product and material configuration.
Pricing, Taxes, Payment, and Order Processing
The amount due, applicable taxes, shipping charges, and any expressly selected rush or other charges are displayed before the customer submits an order. Payment is collected according to the method and amount shown at checkout. Applicable taxes are collected where required.
Orders may undergo verification, fraud review, file preflight, configuration validation, production preparation, and production authorization before fulfillment. If Elate declines or cannot fulfill an order because of a material pricing, configuration, availability, or technical error, the customer will be notified and any amount collected for an unfulfilled item will be refunded, subject to applicable law.
Production and Third-Party Providers
Elate may use qualified third-party production, framing, fulfillment, payment, technology, storage, and shipping providers. Customer, file, and order information reasonably necessary to complete the transaction may be shared with those providers as described in the Privacy & Cookie Policy. Customer-facing production choices are limited to configurations supported by the applicable provider.
Product Images and Reasonable Variation
Digital previews are representative. Screen calibration, lighting, print media, natural materials, framing materials, production tolerances, cropping, and finishing processes may cause reasonable variation in color, texture, scale, or appearance. This does not authorize a product that materially differs from the customer’s confirmed order specifications.
Transaction Terms
Payment: By submitting an order, the customer authorizes the displayed order amount and only those charges expressly selected or otherwise disclosed at checkout.
Order review: An order confirmation acknowledges receipt of the order. Elate may review the order before production authorization for payment security, configuration, availability, pricing, or technical issues. If Elate does not fulfill an item, the customer will be notified and any amount collected for that item will be refunded as required by law.
Made-to-order production: Artwork may be printed, framed, finished, or otherwise produced specifically for the customer’s selected configuration.
Provider validation: If a selected configuration is invalid or unavailable, Elate will obtain the customer’s approval before substituting a materially different option. If no agreed alternative is available, Elate will cancel and refund the affected item.
Delivery estimates: Delivery estimates include the applicable order-processing, production, and transit periods and are governed by the Shipping & Fulfillment Policy.
Cancellation and changes: Requests are governed by the cancellation terms below and do not remove rights that applicable law does not permit Elate to exclude.
Order Changes & Cancellation
Customers may request cancellation or certain order changes within 24 hours after placing an order. Elate will confirm the request and cancellation status. This courtesy period does not reduce any cancellation, return, or refund right provided by applicable law.
After the first 24 hours, Elate reviews a cancellation or change request based on the order’s actual processing stage. If production has not been authorized or the item has not been released for fulfillment, Elate may approve the cancellation or change.
Once production authorization is complete and an item has been released for fulfillment, a voluntary cancellation or material change may no longer be feasible. This does not eliminate any right or remedy required by law or any remedy applicable to a damaged, defective, or materially nonconforming item.
Requests involving artwork, size, frame, matting, finishing, shipping address, personalization, or another production configuration are subject to the same processing-stage review. Any approved change, including any revised price or delivery estimate, will be confirmed before implementation. Elate will not make a materially different substitution without customer approval.
Fraud, Chargebacks, and Payment Reversals
Elate may pause or decline an order before fulfillment when there is a reasonable payment-security or identity concern. The customer will be notified when appropriate. Elate will not retain payment for an order it will not fulfill except as permitted by law and these Terms.
Marketplace Customer Benefit
The Elate Marketplace supports artwork customers by offering selected lighting, hanging, installation, protection, display, and presentation accessories.
Anyone may browse Marketplace products and product information. Purchasing is restricted to qualifying customers who have completed a qualifying Elate artwork purchase.
Marketplace products are offered as a benefit to qualifying Elate artwork customers. Marketplace item price, availability, shipping, and delivery terms are displayed before purchase.
When a Marketplace item is described as “at cost,” “procurement cost,” or “without ordinary retail markup,” the customer pays Elate’s actual acquisition cost for the item plus any separately disclosed direct shipping, taxes, procurement, delivery, or other unavoidable charges associated with obtaining and delivering that item. Elate does not add an ordinary retail markup to these Marketplace items.
Marketplace items are procured after the customer order completes Elate’s payment and processing procedures. Supplier availability and pricing may change. If an item becomes unavailable or its price materially changes before procurement, Elate will notify the customer and obtain approval for any substitute or price change, or cancel and refund the affected item. Elate will not charge a higher price without the customer’s affirmative approval.
Custom Artwork, Uploads and Intellectual Property
Customers may upload photographs, artwork, designs, text, or other content for custom-art or production services. The customer represents that the customer owns the submitted material or has sufficient authorization to permit the requested reproduction, modification, production, and delivery.
The customer grants Elate and necessary service providers a limited, non-exclusive license to copy, resize, crop, color-process, convert, transmit, temporarily store, prepare, print, frame, and otherwise process submitted content only as reasonably necessary to provide the requested product or service or address a customer-service or production issue.
Custom Artwork File Retention
Customer-uploaded artwork is not retained permanently on the Elate Digital Art Gallery website. During configuration, preview, checkout, and production preparation, the artwork file may be held temporarily so the customer can move between the configurator and presentation pages without uploading the same image again.
After a completed purchase, the final production image used for fulfillment may be securely retained in Google Drive for up to ninety (90) days as a temporary production backup. This backup may be used only for fulfillment support, re-transmission to the production provider, production correction, replacement, or another issue directly related to the customer’s order. After the 90-day retention period, the archived production image is automatically deleted.
This 90-day retention policy applies only to the customer artwork image file. It does not require deletion of normal order, transaction, accounting, tax, payment, fulfillment, or customer-service records that Elate is otherwise entitled or required to maintain.
Elate may decline content that is unlawful, infringing, fraudulent, defamatory, exploitative, abusive, or otherwise prohibited by law or company policy. Production preparation may include resizing, cropping, aspect-ratio adjustment, format conversion, bleed preparation, resolution verification, color-profile handling, and other technically necessary modifications. Material alterations beyond ordinary production preparation will be disclosed and approved by the customer.
Purchase of a physical or printed artwork does not automatically transfer copyright, reproduction rights, commercial-use rights, trademark rights, publicity rights, or other intellectual-property rights unless expressly stated in writing.
Unless otherwise indicated, the Elate Digital Art Gallery website, branding, text, layouts, graphics, software, photography, and proprietary content are owned by or licensed to Elate Business Concepts Group, LLC.
